Approach to Arbitration and Mediation

As a result of his 37 years as a trial lawyer, practicing complex business litigation, Mr. Sander dives into each case so that he has an excellent understanding of the factual and legal issues. 

In arbitration cases, this allows him to effectively evaluate the merits of each parties' case and hone in on key issues.  The result is a thoughtful and reasoned decision, based on the facts and applicable law.

In mediation, Mr. Sander is not a "note passer" who simply communicates the respective parties' position on issues or settlement amounts.  To the contrary, Mr. Sander evaluates the merits of each parties' case and effectively communicates to the parties' their risks and likely range of outcomes if the case goes to trial.  Mr. Sander has found this approach to be much more effective and useful to the parties.

Why Mr. Sander is an Effective Arbitrator and Mediator

Mr. Sander is an American Arbitration Association trained and certified arbitrator and mediator.  In addition, as a trial lawyer, Mr. Sander routinely represented clients in arbitrations and mediations.  Mr. Sander's background trying cases includes trying two nine figure cases for national corporations, resulting in favorable verdicts.  He also litigated dozens of seven and eight figures cases, either to verdict or resolution.  Additionally, throughout his career, Mr. Sander represented small businesses, business executives, employees and business owners (including shareholders and members) in business disputes.  

 

Mr. Sander's effectiveness was consistently recognized by his peers. Mr. Sander was the Chair Emeritus of the Complex Commercial Litigation Institute and was a member of the Litigation Counsel of America, an invitation only society comprised of less than one-half of one percent of American trial lawyers.  Mr. Sander was a “Super Lawyer” for each year from 2007 - 2020 and for more than a decade he was selected as one of The Best Lawyers in America (U.S. News & World Report).Mr. Sander consistently has received the AV Preeminent peer review rating from Martindale Hubbell© (highest rating for legal ability and ethical standards).

 

Mr. Sander served as a commissioner on the Judicial Performance Commission, having been appointed by the Chief Justice of the Colorado Supreme Court.  The commission is charged with evaluating the performance of sitting judges and recommending to voters whether judges should be retained or not retained. 

 

Since 2018, Mr. Sander has been the board president of the Epilepsy Foundation of Colorado and Wyoming and has sat on the board since 2014.  The Foundation provides services and support for the over 60,000 Colorado and Wyoming residents with epilepsy, and their families.  

 

Mr. Sander graduated from the University of California at Berkeley with an AB degree in economics.  Mr. Sander received his JD from the University of Colorado.
